A Unified Theory of Indian Tribal Sovereignty

Abstract

The author examines the three areas of law, tribal power, state jurisdiction, and equal protection, in which Indian tribal sovereignty is an operative principle. The proper role of sovereignty in each area is derived, and a cohesive theory of tribal sovereignty is postulated, with a view to defining the proper scope of state and local action relating to Indian affairs.
